In terms of the National Environmental Management Biodiversity Act (NEMBA), There are over 550 Invasive
Alien Species including more than 350 plant species appearing in 4 different categories ranging from
'Totally Prohibited' to 'cannot be propagated'.
With effect from 1 October 2014, it became a legal requirement that the Seller of any property must, prior to the conclusion of the relevant sale agreement,
notify the Purchaser of the property, in writing, of the presence of listed Invasive Alien Species.
The Sellers must notify Purchasers in writing of the fact that alien species may exist when marketing the property and the sale agreement should include an acknowledgment by the
Purchaser of this fact.
